Position: Legal grounding of the right to (mental) integrity of the person and its protection against AI-driven threats under EU law

Apart from being protected under Article 3 of the EU Charter of Fundamental Rights, mental integrity is also an increasingly crucial concept in the digital era, where AI technologies can shape cognition, emotion, and decision-making. Despite its importance, the notion remains insufficiently defined and unevenly protected across legal and theoretical frameworks. In this dissertation, we aim to articulate a clear and comprehensive definition of mental integrity grounded in EU doctrine and analyse whether existing EU legislation, such as the AI Act, GDPR, DSA, DMA, and medical and consumer regulations, can meaningfully protect this right against serious negative AI-driven impacts. The goal is to identify gaps and outline the steps necessary to ensure coherent and effective safeguarding of mental integrity within the EU legal framework.
